Section 3: Comprehensive Standard 3.2.5

The governing board has a policy whereby members can be dismissed only for appropriate reasons and by a fair process.

 

Statement of Compliance: Dyersburg State Community College is in compliance with Comprehensive Standard 3.2.5.

 

Rationale for Judgment of Compliance:

Tennessee Board of Regents (TBR) members may be removed under provisions of state law found in Tennessee Code Annotated 8-47-101 Title 8 Public Officers and Employees/Chapter 47 Removal of Officers [Ref 1].  Board members may be removed by the Governor of Tennessee or by the Board for conflict of interest under Tennessee Code Annotated 49-8-203 Title 49 Education Chapter 8 State University and Community College System/Part 2 Board of Regents [Ref 2] and under TBR Policy 1:02:03:10 Conflict of Interest Sections 11, 12 and 13. Section 13 describes the appeal process assuring due process [Ref 3].

Board officers “may be removed by the Board by the affirmative vote of a majority of the Board, not merely the quorum,” under TBR Policy 1:02:05:00 Paragraph 3 [Ref 4].
